Board Minutes – May 9, 2022

The Adams County Board of Supervisors met on Monday, May 9, 2022 at 9:00 am with the following members present: Bobbi Maynes, Leland Shipley, Merlin Dixon, Scott Akin, and Doug Birt. The meeting was called to order by Chairperson Birt and the Pledge of Allegiance was recited. Akin moved, seconded by Maynes to approve the agenda for the day along with the minutes of the May 2, 2022 meetings.  All supervisors voted aye.  Motion carried.

Shipley moved, seconded by Dixon to approve the Utility Permit #22-02 for SIRWA on Quarry Rd. All supervisors voted aye.  Motion carried.

Roads Supervisor Karl McCarty updated the board on the Secondary Roads Department. He said they are down to one semi-truck as of this morning. The crew is busy hauling contract rock.

Akin moved, seconded by Dixon to approve the claims as presented. All supervisors voted aye.  Motion carried.

Shipley moved, seconded by Maynes to approve a County Burial Request.  All supervisors voted aye.  Motion carried.

Discussion on updating the vacation pay-out at separation of employment was tabled until we hear back from the County’s HR consultant.

Dixon moved, seconded by Akin to approve Resolution 2022-22 calling election on proposal to enter into a loan agreement and issue General Obligation Bonds for the purpose of funding a certain Adams County Courthouse Project.

Resolution calling election on proposal to enter into a loan agreement and issue General Obligation Bonds for the purpose of funding a certain Adams County Courthouse Project

WHEREAS, the Board of Supervisors (the “Board”) of Adams County, Iowa (the “County”), has established the Adams County Courthouse Urban Renewal Area (the “Urban Renewal Area”); and

WHEREAS, the Board heretofore proposed to enter into a General Obligation Urban Renewal Courthouse Improvement Loan Agreement (the “Loan Agreement”) and to issue general obligation bonds in a principal amount not to exceed $8,500,000 pursuant to the provisions of Subsection 331.441(2)(b)(14), Section 331.402, Section 331.442, and Chapter 403 of the Code of Iowa, for the purpose of carrying out the Adams County Courthouse Project (the “Courthouse Project”), a project in the Adams County Courthouse Urban Renewal Area authorized by action of the Board on February 28, 2022, and in lieu of calling an election upon such proposal, has published notice of the proposed action and has held a hearing thereon, and on or before March 21, 2022, a petition was filed with the County asking that the question of entering into the Loan Agreement be submitted to the registered voters of the County; and

WHEREAS, the Board deems it necessary and advisable that the County continue to pursue authorization of the proposal to enter into the Loan Agreement and to issue General Obligation Bonds (the “Bonds”) in evidence of its obligations thereunder; and

WHEREAS, pursuant to Sections 331.402 and 331.442 of the Code of Iowa, before the County may authorize the proposal to enter into the Loan Agreement and issue the Bonds, the County must hold a special election upon such proposition and receive a favorable vote from at least 60% of the total votes cast at such special election; and

WHEREAS, in accordance with Section 331.442 of the Code of Iowa, as part of the Board’s action to set a date for an election on such proposition, the Board must publish notice of such proposition, including a statement of the amount and purposes of the loan agreement and the bonds to be issued, and a statement of the estimated cost of the Courthouse Project, which notice must be published, as provided in Section 331.305 of the Code of Iowa, with the minutes of the meeting at which the Board adopts a resolution setting the date for an election on the question of entering into the loan agreement and issuing such bonds;

NOW, THEREFORE, IT IS RESOLVED by the Board of Supervisors of Adams County, Iowa, as follows:

Section 1. The Board of Supervisors intends to undertake the Courthouse Project, as more particularly described in Section 2 below, at an estimated cost of $8,500,000. In accordance with Section 331.442 of the Code of Iowa, this cost figure is an estimate and shall not be binding on the Board in later proceedings related to the Courthouse Project.

Section 2. A special county election is hereby called and ordered to be held in and for the County in conjunction with the general election on September 13, 2022, at which there will be submitted to the voters of the County the following proposition:

“Shall Adams County, State of Iowa, enter into a loan agreement and issue its general obligation bonds in an amount not exceeding $8,500,000, for the purpose of undertaking renovations to the County Courthouse, primarily including, but not limited to, constructing an addition to the front of the building for improved public access and improving, furnishing and equipping Sheriff s Department facilities, offices and common areas?”

Section 3. All of the foregoing matters are adopted and resolved by this Board, and the County Auditor is hereby authorized and directed to issue a proclamation and notice of the proposition and of the time and place of the election and to take all other actions necessary pursuant to state law to conduct the election. In addition, in accordance with Sections 331.305 and 331.442 of the Code of Iowa, the County Auditor is hereby authorized and directed to publish the minutes of the Board meeting at which this Resolution is adopted, including the full text of this Resolution, and to publish along with those minutes the Board’s Notice of Special Bond Election that is attached to this Resolution.

Section 4.  All resolutions or parts of resolutions in conflict herewith are hereby repealed, to the extent of such conflict.

Passed and approved May 9, 2022.  All supervisors voted aye.  Motion carried. Attested by Adams County Auditor, Rebecca Bissell. The original resolution is on file in the Auditor’s Office.

Akin moved, seconded by Dixon to approve continuing design work on the County Court House Renovations. All supervisors voted aye.  Motion carried.

Department Head Reports – IT – Tom Williams set up software to monitor the traffic trying to gain access to our systems, Treasurer – Holly Shafer stated May notices went out so have been seeing more taxes come in. The county taxes are down to $126,000 left to collect. Auditor – Becky Bissell shared they had a building security assessment to review the Courthouse’s security. The way the Business Property Tax Credit (BPTC) is administered has been changed with the signing of HF 2552. She also shared that mailed ballots can go out beginning on May 18th and that In-Person Absentee voting will begin in the Auditor’s office on May 18th as well.

Committee and Meeting reports were presented as follows:  Maynes – RC&D, Creston, May 5.

Dixon moved, seconded by Akin to adjourn at 10:15 am.  All supervisors voted aye.  Motion carried.
