Board Minutes – January 3, 2022

The Adams County Board of Supervisors met on Monday, January 3, 2022 at 9:00 am with the following members present: Bobbi Maynes, Leland Shipley, Doug Birt and Scott Akin. Merlin Dixon was absent. The meeting was called to order by Auditor Bissell and the Pledge of Allegiance was recited. Maynes moved, seconded by Akin to appoint Doug Birt as the 2022 Chairperson. All supervisors voted aye.  Motion carried. Birt took over the meeting. Akin moved, seconded by Shipley to approve today’s agenda along with the minutes from December 27, 2021.  All supervisors voted aye.  Motion carried.

Engineer Travis Malone gave an update on the Secondary Roads department. He also discussed some of his budget ideas and will get on the agenda to present shortly.

Shipley moved, seconded by Akin to approve the plans for Project FM-C002(79)—5502. All supervisors voted aye.  Motion carried.

Shipley moved, seconded by Maynes to approve Resolution 2022-1 the Organizational Meeting Appointments for 2022 to make all the appointments official except appointments to the Condemnation Board and the Zoning Board of Adjustments which were tabled.  All supervisors voted aye.  Motion carried.

Resolution 2022-1

            Maynes moved, seconded by Akin to appoint Doug Birt as Chair of the Adams County Board of Supervisors.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Maynes to appoint Leland Shipley as Vice-Chair of the Adams County Board of Supervisors.  All supervisors voted aye.  Motion carried.

            Shipley moved, seconded by Maynes to make the Adams County Free Press the official newspaper for the year 2022.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Shipley to make TS Bank the official depository for the year 2022. All supervisors voted aye.  Motion carried.

            Maynes moved, seconded by Shipley to issue checks during the year 2022 per section 331.506 of the 2021 Code of Iowa.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Maynes to set the mileage rate at 50 cents per mile effective January 1, 2022.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Maynes to appoint Jerry Peckham, Nicci Tucker, and Kathy West to serve one-year terms on the Human Services Board.  All supervisors voted aye.  Motion carried.

            Shipley moved, seconded by Akin to appoint Lindsey Hogan to a three-year term on the Board of Health.  All supervisors voted aye.  Motion carried.

            Shipley moved, seconded by Maynes to appoint Larry Maeder as Adams County Weed Commissioner effective March 1, 2022.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Maynes to appoint Bill Lyddon as Adams County Emergency Management Director.  All supervisors voted aye.  Motion carried.

            Shipley moved, seconded by Maynes to appoint Kevin Provost for a one-year term as Adams County Veterans Director.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Maynes to appoint Dr. Steven Freeman to a one-year term as Adams County Medical Examiner.  All supervisors voted aye.  Motion carried.

            Shipley moved, seconded by Maynes to appoint Dr. Stephen Gruba to a one-year term as Adams County Assistant Medical Director.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Shipley to appoint Lisa Brown to a one-year term as Adams County Medical Examiner Investigator.  All supervisors voted aye.  Motion carried.

            Maynes moved, seconded by Shipley to appoint Billi Vavra to a one-year term as Adams County Medical Examiner Investigator Assistant.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Shipley to appoint Marnie Cline to a 5-year term on the Adams County Conservation Board.  All supervisors voted aye.  Motion carried.

            Akin moved seconded by Shipley to appoint Jason McManis, Patty Peterson, and Doug Calkins each to 2-year terms on the Adams County Zoning and Planning Commission.  All supervisors voted aye.  Motion carried.

            Maynes moved, seconded by Akin to appoint Nancy Carmichael, Saundra Leininger and Dick Blazek each to 2-year terms to the Adams County Certified Local Government Commission.  All supervisors voted aye.  Motion carried.

            Akin moved, seconded by Shipley to approve the Adams County General Relief Assistance guidelines for 2022.  All supervisors voted aye.  Motion carried. 

            Akin moved to set the holiday closing schedule for 2022.  It died for lack of a second.  Maynes moved, seconded by Shipley to set the holiday closing schedule for 2022 with the change of reducing Christmas Eve and New Year’s Eve from a full day to a half-day and adding the observance of Columbus Day.  All supervisors voted aye.  Motion carried.

Shipley moved, seconded by Akin to approve Resolution 2022-2 Construction Evaluation Resolution for the Master Matrix. All supervisors voted aye.  Motion carried.

Resolution 2022-2

Construction Evaluation Resolution

WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and

WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2022 and January 31, 2023 and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF

ADAMS COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3). 

Kurt Sargent, CHI Mercy Health Administrator, gave an update on the Ambulance Department and the financials. Sargent informed the board the need to purchase a Lucas Device for the new ambulance. The Lucas Device costs around $15,000. They are going to try to get a grant to offset some of the costs of the device.

County Sanitarian Carl Goodson shared with the board a new grant opportunity with Federal ARPA funds for updating wastewater systems in the unsewered communities in Adams County. He has reached out to individuals and mayors trying to get anyone who qualifies signed up. He asked the board to waive the upfront permit fee as those fees are paid for by the grant and the County would receive payment once the grant has been approved. The board agreed and told Carl to continue to push the project and help constituents navigate the process and thanked him for all his work.

Auditor Bissell presented the historical data for the past 7 years of the County’s debt levy.

Shipley moved, seconded by Akin to approve opening the Public Hearing for Ordinance 2022-1 Establishing Adams County Precincts at 10:05 am.  All supervisors voted aye.  Motion carried. There were no written or oral objections. Shipley moved, seconded by Maynes to close the public hearing at 10:10 am.

Shipley moved, seconded by Akin to waive the second and third reading and to approve Ordinance 2022-1 Establishing Adams County Precincts. All supervisors voted aye.  Motion carried.

EMA Director Bill Lyddon presented new policies that are needed for the federal grants and funds EMA is trying to secure and also reviewed the Adams County Procurement Policy. Akin moved, seconded by Maynes to approve the Personally Identifiable Information Policy and Procedures for Determining Allowable Costs for Federal Programs Policy. All supervisors voted aye.  Motion carried.

Department Head updates were presented as follows: Conservation – had the cottages filled over the holiday weekends and working on budget figures; IT – working on an email attachment issue.

Budgets Requests were presented by Evan Maynes for the 4H/ Fair.

Akin moved, seconded by Maynes to adjourn the meeting at 11:45 am

The 2021 Employee Gross Wages were hereby published according to Section 349.18 of the 2021 Code of Iowa.
